Postsecondary School and State Authorization Act
In March 2023, the Utah State Legislature passed S.B. 180 repealing and replacing the Utah Postsecondary Proprietary School Act with the Utah Postsecondary School and State Authorization Act, effective January 1, 2024. The new law requires postsecondary schools to submit an annual registration statement with the Division. Other changes to the law included modification of the exemption, registration, and surety requirements, new outcome disclosures schools must provide and clarifications to the Division's enforcement authority.
Until S.B. 180 takes effect on January 1, 2024, your institution will continue to file registration and registration review applications, if applicable, as required by the Utah Postsecondary Proprietary School Act. Please consult the Division's website for additional information closer to the statute implementation date.

Under the Utah Postsecondary Proprietary School Act, Utah Code §13-34 any private institution, including business, modeling, paramedical, tax preparation, trade and technical schools, which offer post-secondary education in consideration of the payment of tuition or fees for the attainment of educational, professional or vocational objectives is required to register before advertising, recruiting or operating in this state.
